Copyright term extension will be voted this week

Monday or Tuesday this upcoming week there will be another round in the fight against prolonging the copyright protection term for recorded music in the EU. Now is an opportunity to contact MEPs, Members of the European Parliament, and persuade them to vote against the term extension.

Background: In 2009, the EU discussed the issue of a term extension for the ”neighbouring rights” that record companies have to recorded music. These neighbouring rights are now 50 years from the recording of a song. The proposal was to extend them to 95 years. After a lively debate in the European Parliament, it was decided to extend them to 70 years. Then the issue got stuck in the Council of Ministers, where several countries (including Sweden and Denmark) felt that no extension was necessary. Now it appears that the Danish government has folded, which means that there is no longer a blocking minority in the Council.

Right now:
On the agenda for the meeting of the European Parliament’s legal affairs committee JURI this Monday and Tuesday, there has appeared a point about making certain formal corrections to the text that the European Parliament adopted (such as the date when the new rules should enter into force). It appears that they have been trying to give the issue a low profile. The documents were not sent out to members of the JURI committee until last Friday, after we had explicitly asked for them.

Now we need to raise some attention about this. It would also be useful if Members of the European Parliament (and in particular the ones in the JURI committee) start getting emails from citizens asking them to oppose the term extension.

We are now trying to find out whether it is enough if the changes to the parliament’s position are passed in the JURI committee, or if it will be voted in plenary as well. We will not know for certain until Monday morning.

There are several possibilities here. If the issue is still formally in ”first reading” in the Parliament (after the delay in the Council), there is a chance that we can get either the Green Group of 40 MEPs to demand that the issue is brought up for a renewed proper discussion. Since the European Parliament adopted its position, a new Parliament has been elected. It would be reasonable if we get a chance to have a say on the issue.

There are many questions, loose ends, rules, and possibilities. We who represent the Pirate Party in the European Parliament will be doing what we can. But the issue needs general attention. It would be very good if MEPs start getting mail about the issue. We also need blogs and media to take an interest.

  7. Well,

    your position would be much better supported perhaps if you would tell the audience why you are against extending copyright on audio recordings.

    Do you really think it is of public interest how long the copyright on a song is? Private copies are allowed in most countries. If *I* want a copy I surely have a friend who has it. I’m not hindered in any way by copyright law. So … if I want to make a business by reselling ”old” music, ofc I can’t do that so easy. But otoh, there won’t be much of a market anyway if it is freely copy able.

    I completely fail to understand why we should care about that. There are plenty of more important issues like Patents on Software or Algorithms, e.g.

    Mr. Engström was elected into parliament precisely because the public cares about how long the monopoly protection of an audio recording is.

    It is not just part of his job to judge whether people care. It is the whole reason he is there in the first place. He was elected on that very platform.

  14. If the length becomes absurd, no one will respect it. People that think you can ‘write’ anything by law are just stupid. There are in various countries laws to ”control” guns. Problem ? Well. Criminals don’t give a fuck about law. So what do you think laws about gun control is going to do ? Nothing. Because criminals don’t care about those laws, or any law. Laws only work when people respect or obey them. The more extended those so called ”rights” (it’s not copy protection, it’s copy restriction. Did you guys ever heard of 1984 ? You do think that by misusing langage we are like small sheep gonna believe those lies ?) the more unlawful actions will occur.

    In the end, people will choose. Those laws are not respected today because we, the people, see them as either insane or going too far. You could even write ”death penalty” in the laws to any of us that would not respect it, we would not start respecting or following those laws either.

    This current culture is a read-only culture. What Internet has brought us is a going back to the read-write culture, which is what culture is about. Now that the cat is out of the bag, those majors, those persons are screwed. Because we realize they tried to fuck us, and failed. Because we also realize that we don’t give a fuck about those laws. 50 years ? 5000 years ? We don’t care anymore. Because you politicians have let corporations corrupt and misuse the law, now we don’t respect it. And you are really wondering about a copyright extension ? The more extended it is, the less people will accept or respect it.

    They’re screwed. And the closer to their death, the more noise they will do. But they will die.
    They know it. We know it. Let’s have some pop-corn and watch them die.

  27. The neighbouring should not be extended until the current rights can be secured. It takes only a couple of days before the copyright is infringed using sites as The Pirate Bay, supported by the Swedish Pirate Party.
