An insult to the Parliament

This is a translation of an entry in Swedish that I posted yesterday.

Thursday October 22, there was a trialogue meeting about the telecoms package. The three negotiators representing the European Parliament met with representatives for the Council om Ministers to discuss a text to replace the famous Amendment 138.

The Council of Ministers presented the following proposal. Additions in bold compared to the text agreed by the Parliaments delegation in the October 20 meeting, deletions crossed out.

3a. Measures taken by Member States regarding end-users’ access to or use of services and applications through electronic communications networks shall respect the fundamental rights and freedoms of natural persons, as guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms and general principles of Community law.

Any of the above measures liable to restrict those fundamental rights or freedoms may therefore only be taken in exceptional circumstances and imposed if they are appropriate, proportionate and necessary within a democratic society, and shall be subject to adequate procedural safeguards in conformity with the European Convention for the Protection of Human Rights and Fundamental Freedoms and with general principles of Community law, including effective judicial protection and due process. In particular, any These measures may only be adopted as a result of a prior, shall respect the requirements of a fair and impartial procedure ensuring inter alia that the principle of presumption of innocence and including the right to be heard of the person or persons concerned be fully respected. Furthermore, and the right to an effective and timely judicial review shall be guaranteed.

This shall not affect the competence of a Member State, in conformity with its own constitutional order and with fundamental rights, inter alia, to establish a requirement of a judicial decision authorising the measures to be taken and to adopt urgent measures in order to assure national security, defence, public security and the prevention, investigation, detection and prosecution of criminal offences.

If you don’t feel like digging into text comparisons, I’ll provide an executive summary:

The Council has removed all amendments that the Parliament inserted to guarantee that nobody will be shut off from the Internet without at least a prior trial, and reverted to a position that is identical in substance to what the Council and the Commission have previously proposed.

An even more executive summary:

The Council shows its complete contempt for the Parliament by totally ignoring its views. The ministers intend to teach the Parliament a lesson, and once and for all show who’s in charge.

This procedure is called ”co-decision”, in case anyone wondered. It is often cited as an example of how democratic the European Union is.

  4. It’s quite easy, isn’t it.

    Either, the council as all others confirms that our countries abide by the European Convention, as is the simple thing remaining.

    Or, the council in some misguided attempt to comfort Mr. Sarkozy in his childplay games of pretending that the European Convention would be arbitrary to France, cancels the telecoms package in it’s current form.

    If the council persists, I will be happy to see the telecoms package being cancelled to protect paramount citizen rights.

    Let’s then not start crafting a new telecomes package.

    Instead, the next step ahead is starting to discuss the European Convention, whether it should remain, what for, why, how we dismantle or protect it, etc.

    We shouldn’t have conventions if they’re worth less than the misguided mind of a person, be it a Mr. Sarkozy or anyone else of us.

  7. Maybe it actually was an insult, doh, considering internal politics and all? But prolly it was just same old same old.

    Learn everything there is about the internal rules and regulations, as quickly as humanly possible. That’ll be the only way you can figure out how to get the upper hand in most situations. Just remember your in office ‘cause your an idealist, and not ‘cause it’s all about a political career.

  12. Hej. Jag föddes under Sveriges begynnande moderna storhetstid, 60-talet. Idag är jag 47 år och grymt besviken på den begynnande smyg fascistiska politik som idag bedrivs i stort sett i alla länder i Europa. Jag läste boken 1984 när den var fortfarande bara var en i mängden av bra sci-fi berättelser som jag slukade, men den stannade kvar i tankarna. Genom åren sedan jag läste den har den mer och mer blivit en uppfylld profetia om den moderna staten. Nu är den inte längre en sci-fi story, den har blivit en sanning i vardandet och bildandet av bl.a den nya FRA lagen.

    Jag är en av de många tusentals gräsrötter som fick in Piratpartiet i EU-parlamentet och kunde någon med insikt, förståelse och tillräcklig ”smartness”, fläta ihop det som PP står för tillsammans med kärnan av den socialdemokratiska grundpolitiken, om det går att få ihop så finns där grunden till en verklig föränderlig fungerande politik för den enskilde likväll som för massan, ja då finns det ett hopp även för framtiden.

    Sluta aldrig med att ”bråka” inom politiken. Sluta aldrig med att berätta även de mest triviala lagförändringar och lagtillägg som görs för att stjäla kontrollen över oss, vi som är längst ned på näringskedjan inom all politik, gräsrötterna.

    Om det ändå kunde få komma fram en ny Gunnar Sträng, Olof PALME eller en helt ny version av den ”goda” politikern som arbetade för ALLAS bästa, och inte för sin egen skull. För tyvärr finns det idag INGEN som ens kommer i närheten av deras retorik och kunnande om vad som är rätt för ett land som Sverige.

    DU GÖR ETT BRA JOBB. Låt ingen ta ifrån dig den vetskapen, DU GÖR ETT BRA JOBB!
