Piratpartister nominerar Bradley Manning till Nobels fredspris

Piratpartiets ledamöter i Europaparlamentet, Christian Engström och Amelia Andersdotter, har nominerat Bradley Manning till Nobels fredspris.

Manning är den soldat som står inför rätta i USA för att ha läckt information om krigen i Irak och Afghanistan samt amerikanska ambassadtelegram till Wikileaks. Bland de övriga som undertecknat nomineringen märks den isländska alltingsledamoten Birgitta Jónsdóttir och den tunisiske internetaktivisten och ex-ministern Slim Amamou.

- Bradley Manning har gjort en genuint demokratisk gärning. Han har visat vanligt folk vad som sker i de krig som våra ledare för i vårt namn. Och han har avslöjat att våra politiker i verkligheten driver en annan politik än den de gått till val på och fått demokratiskt mandat för, säger Christian Engström som är ledamot av Europaparlamentet för Piratpartiet.

- Manning visar ett civilkurage som är allt för sällsynt. Efter att den norska nobelkommittén under flera år delat ut fredspriset till politiska ledare vars insatser för freden kan ifrågasättas, så är det dags att man ger priset till en verklig hjälte. Det säger Amelia Andersdotter, piratpartistik ledamot av Europaparlamentet.

Bradley Manning har suttit fängslad mer än 1.000 dagar. Just nu pågår rättegången mot honom i USA, i vilken han riskerar att dömas till livstids fängelse.

Kreditkortsföretagen får inte hota närings- och yttrandefriheten

Aftonbladet publicerar idag en debattartikel av mig om hur de stora betalningsförmedlarna som Visa, MasterCard och PayPal hotar både näringsfriheten (som när de blockerade ett par svenska småföretag som säljer skräckfilm respektive sexleksaker) och yttrandefriheten (som när de blockerade Wikileaks).

Det är helt oacceptabelt att amerikanska privata företag har den här makten över oss alla.

Accused Wikileaker Bradley Manning to Have his Day in Court

After 18 months in prison, Bradley Manning, the young American soldier accused of leaking thousands of classified documents to Wikileaks, will finally have his day in court.  Next Friday, Dec. 16, Private First Class Manning will appear before a military judge for a pre-trial hearing at Fort Meade, Maryland, not far from Washington, DC.  The “Article 32” hearing, expected to last 4 or 5 days, will determine whether there is enough evidence against Manning to go ahead with a military court martial.  Prosecution and defense lawyers will reveal their respective strategies for the first time.

Two weeks ago, I and 63 colleagues in the European Parliament sent an open letter to the US Administration questioning why Mr Manning has been held for so long without a trial, and why the US administration has refused to let the UN Special Rapporteur on Torture meet with Mr Manning in private, as the UN has demanded.

Regardless of whether Mr Manning did in fact leak the documents to Wikileaks or not, the US Army treatment of him has been a disgrace. It is not a crime to expose war crimes. And in a country that respects the rule of law, nobody should be kept in prison for 18 months without a trial.

Presskonferens i EU-parlamentet om Bradley Manning

I förmiddags var jag med på en presskonferens här i Europaparlamentet om Bradley Manning, soldaten som den amerikanska regeringen pekar ut som den som läckte materialet om krigen i Irak och Afghanistan till Wikileaks.

Tillsammans med ett 60-tal andra EU-parlamentariker har vi skrivit ett öppet brev till den amerikanska administrationen, där vi kräver att FN:s speciella rapportör för tortyr ska få möjlighet att träffa Bradley Manning i enrum. FN har bett om det, men hittills har USA vägrat.

Skälet till att FN:s rapportör för tortyr är intresserad av fallet är att Bradley Manning hölls i isoleringscell under de första 8 månaderna sedan han arresterades.

Totalt har Manning suttit fängslad i 18 månader i väntan på rättegång, men nu ska rättegången äntligen inledas den 16 december.

As Members of the European Parliament, who were elected to represent our constituents throughout Europe, we are writing to express our concerns about alleged human rights violations against Bradley Manning, a young soldier who has been accused of releasing classified information pertaining to possible U.S. war crimes in Iraq and Afghanistan. We are concerned that the U.S. Army has charged Bradley Manning with “aiding the enemy,” a capital offense that is punishable by death. We have questions about why Mr. Manning has been imprisoned for 17 months without yet having had his day in court. We are troubled by reports that Mr. Manning has been subjected to prolonged solitary confinement and other abusive treatment tantamount to torture. And we are disappointed that the U.S. government has denied the request of the United Nations Special Rapporteur on Torture to meet privately with Mr. Manning in order to conduct an investigation of his treatment by U.S. military authorities.

We call upon the United States government to allow Juan Mendez, the United Nations Special Rapporteur on Torture, to conduct a private meeting with Bradley Manning, the accused WikiLeaks whistle-blower. Mr. Mendez has made repeated requests to American officials to meet privately with Mr. Manning in response to evidence that he was subjected to abusive confinement conditions while he was detained at a facility in Quantico, Virginia. Mr. Manning was held in solitary confinement for 23 hours per day during the eight months he was incarcerated at that location. It appears that he was at times forced to sleep and stand at attention without any clothing. His legal counsel has documented additional incidents which indicate the possibility of other rights violations.

Hundreds of U.S. legal scholars have signed an open letter to the Obama administration, arguing that the conditions of confinement endured by Mr. Manning at Quantico may have amounted to torture. Following worldwide calls for an end to the abusive treatment, Manning was moved to a facility in Fort Leavenworth, Kansas, where his conditions are said to have improved. The U.S. military conducted an internal investigation into the allegations of mistreatment at Quantico. The preliminary results of this investigation found that Mr. Manning was improperly placed on ”prevention of injury” status, against the recommendations of qualified medical personnel. However, these findings were ultimately overturned by a military prison official who was implicated by the report. Therefore, the U.S. military’s internal investigation has been compromised by clear conflicts of interest. This so-called “prevention of injury” status was the justification for a number of extraordinary measures, such as denying Mr. Manning comfortable bedding and not allowing him to exercise.

By preventing U.N. officials from carrying out their duties, the United States government risks undermining support for the work of the United Nations elsewhere, particularly its mandate to investigate allegations of torture and human rights abuses. In order to uphold the rights guaranteed to Bradley Manning under international human rights law and the U.S. Constitution, it is imperative that the United Nations Special Rapporteur be allowed to properly investigate evidence of rights abuses. PFC Manning has a right to be free from cruel and unusual punishment. People accused of crimes must not be subjected to any form of punishment before being brought to trial.

Finally, we in the European Union are totally opposed to the death penalty. And we certainly do not understand why an alleged whistleblower is being threatened with the death penalty, or the possibility of life in prison. We also question whether Bradley Manning’s right to due process has been upheld, as he has now spent over 17 months in pre-trial confinement.

Furthermore, Bradley Manning should not be forced to waive his right against self-incrimination in order to speak with anyone who seeks to investigate evidence of abuse in their official capacity.

Consistent with these internationally-recognized standards, as well as the rules governing his mandate, United Nations Special Rapporteur on Torture Juan Mendez must be allowed to conduct an unmonitored meeting with Bradley Manning, without any further delay.

Julian Assange i rätten idag

The Guardian rapporterar fortlöpande från utvisningsrättegången mot Julian Assange

Wikileaks grundare Julian Assange sitter just nu i domstolen i England för att få utvisningen till Sverige prövad. Förhandlingarna ska pågå idag tisdag och imorgon onsdag, men domslutet kommer antagligen att dröja ytterligare någon tid.

Alla internationella media rapporterar om fallet, till exempel CNN och AFP. The Guardian har en artikel som de uppdaterar fortlöpande under dagen med det allra senaste.

Uppdatering: The Guardians livebloggning fortsätter med dag två på den här adressen.

I Sverige skriver bland annat Aftonbladet, Expressen, SvD och SVT.

I helgen passade Julian Assange på att fylla 40 år, och fira det med en stor fest på godset där han sitter i husarrest. Bland gästerna fanns Piratpartiets grundare Rick Falkvinge. Aftonbladet och GP skrev om 40-årsfesten.

The Swedish government shared its concerns about the success of the Pirate Party with the US ambassador

In discussions with the US ambassador in September 2009, Sweden’s deputy prime minister Maud Olofsson said that the Pirate Party’s success in the European elections showed that young people don’t trust the government, according to a #cablegate cable.

Bridging the Gap on Illegal File Sharing

(SBU) The Ambassador concluded the meeting by raising intellectual property rights, since Olofsson’s party (the Center Party) is the one member of the ruling coalition least supportive of U.S. efforts to improve Sweden’s efforts against illegal file sharing. Olofsson said there are discussions within the government about putting more legislation in place against file sharing. While legislation is needed, and Sweden follows European level legislation, she argued that a solution should not only be left to politicians via legislation. The problem was a market failure, the lack of a product that people could easily access at a reasonable price. Many young people, she said, think that all file sharing is free. It is hard to change their perception of the rules. Olofsson said she wanted artists and creative people to be paid for their ideas, but we need to create a market solution that is easy for people to follow.

20. (SBU) The U.S. side countered that as knowledge-based economies, both the U.S. and Sweden have a lot to loose from illegal file sharing. We need to make this public debate about the artists being stolen from.

21. (SBU) Olofsson noted that Nokia and Ericsson have introduced new services to share products while paying the artists, which is good. We need to find a way to pay artists property, not just to pass legislation, she repeated.

22. (SBU) Olofsson said we need to understand how young people see the problem. We should talk about what is happening now, not just pass legislation, she stressed. She pointed to the success of Sweden’s Pirate Party in the European Parliamentary elections as an example of that young people ”do not trust us.” She said the Pirate Party attracted voters from both the right and the left, and the Pirate Party MEP now has two advisors, one with a background in the Left Party, and one from a neo-liberal party.

If it is any help to intelligence analysts on the other side of the Atlantic, I can confirm that the Pirate Party is indeed neutral on left-right issues. Instead, we focus all our energies on working for intellectual property reform, and trying to protect the fundamental rights in the age of the Internet.

For this reason we are very concerned about many actions taken by the US administration lately, such as the attempt to curtail freedom of speech by harassing the Wikileaks organisation by judicial and extra-judicial means.

Question to Commissioner Malmström on Wikileaks and Swift

Can EU Commissioner Cecilia Malmström guarantee that Swift data is not used by the US to identify Wikileaks donors?

A couple of months ago the EU concluded and agreement with the US called the Terrorist Finance Tracking Program, or TFTP. It means that data about Europeans’ banking transactions will be transfered in bulk to the US government from the Swift bank data system.

”The European Commission has negotiated on behalf of the European Union an agreement that will increase the security of European citizens while at the same time fully respecting their rights to privacy and data protection”, said Cecilia Malmström, Commissioner for Home Affairs.

The Pirate Party and many other civil liberties organisations were critical of the agreement, since it means that data about private citizens who are not suspected of any crime is being handed out to the US police and security services. We pointed out that once the data has been transferred, EU authorities no longer have any control over how it is used.

The recent events around the Wikileaks whistle-blower site have highlighted the concerns we had when the Swift agreement was signed.

We have seen how the US government has put pressure on Mastercard, Visa, and Paypal to stop doing business with Wikileaks, and to confiscate Wikileaks’ assets. This has been done completely outside the law, before any charges of any crime have even been brought against Wikileaks.

Against this background, how do we know that the US does not use the Swift data to identify people in Europe who have donated money to Wikileaks?

As a member of the European Parliament, I have the right to ask questions to the Commission according Rule 117 of the Rules of Procedure. I have just submitted the following question:

What provisions are there in the recently concluded TFTP agreement to ensure that the US government will not use Swift data to track Europeans who donate money to Wikileaks, and how can the Commission guarantee the enforcement of these provisions?

The answer from the Commissioner Malmström should appear here and be due in six weeks. With the holiday season coming up, this probably means some time in February.

But I have no doubt that Wikileaks will still be in the headlines then as well.

Här kommer en jäkla massa bra, läsvärda länkar om Wikileaks. Jag har tyvärr inte tid att skriva en egen, längre analys om Wikileaks, men min hållning är glasklar – Wikileaks fyller en viktig funktion för att vi medborgare ska kunna granska våra makthavare, och även om vissa enskilda individer drabbas negativt av publiceringarna, så är alternativet så mycket värre – en stängd, sluten stat.
