An EU proposal to ban porn through ”self-regulation”

Next week in Strasbourg, probably on Tuesday, the European Parliament will be voting on a Report on eliminating gender stereotypes in the EU. To promote gender equality and eliminating gender stereotypes are of course very laudable goals, so my guess would be that unless something happens, the report will be approved by the parliament, possibly by a very large majority.

But as always, the devil is in the detail.

Article 17 of the report says (with emphasis added):

17. Calls on the EU and its Member States to take concrete action on its resolution of 16 September 1997 on discrimination against women in advertising, which called for a ban on all forms of pornography in the media and on the advertising of sex tourism;

The resolution of 16 September 1997 in turn said:

5. Calls for statutory measures to prevent any form of pornography in the media and in advertising and for a ban on advertising for pornographic products and sex tourism;

To a certain extent, the exact meaning on this proposed ban on pornography is unclear, since neither the 1997 resolution nor the text we will be voting on next week contains any definition of what is meant by ”in the media”.

Magazines and cable television would presumably be considered to be ”media” by most people, but what about the internet? Without any definition of ”media” in either of the two resolutions, the answer is not obvious from reading just those two articles, at least not to me.

But the resolution we will be voting on next week has other things to say about the internet. Article 14 reads (again with my highlighting):

14. Points out that a policy to eliminate stereotypes in the media will of necessity involve action in the digital field; considers that this requires the launching of initiatives coordinated at EU level with a view to developing a genuine culture of equality on the internet; calls on the Commission to draw up in partnership with the parties concerned a charter to which all internet operators will be invited to adhere;

This is quite clearly yet another attempt to get the internet service providers to start policing what citizens do on the internet, not by legislation, but by ”self-regulation”. This is something we have seen before in a number of different proposals, and which is one of the big threats against information freedom in our society.

The digital rights organisation EDRI has produced a booklet called The slide from ”self-regulation” to corporate censorship, where they point out that:

…now, increasing coercion of internet intermediaries to police and punish their own consumers is being implemented under the flag of “self-regulation” even though it is not regulation – it is policing – and it is not “self-” because it is their consumers and not themselves that are being policed.

In the battle against the ACTA treaty, the fact that ACTA contained similar ”self-regulation” proposals to get internet service providers to start policing their customers was one of the reasons why the European Parliament rejected the treaty in the end.

Many members of the parliament (including me) felt and feel that this kind of ”self-regulation” is nothing more than an attempt to circumvent the article on information freedom in the European Convention on Human rights, which says that everyone has the right to receive and impart information without interference by public authority and regardless of frontiers, and that any restrictions to this right have to be prescribed by law and be necessary in a democratic society.

Next week’s resolution is a so-called ”own initiative report” by the parliament. This means that it does not automatically become law even if it is adopted, but is just a way for the European parliament to express its opinion.

But the purpose of these own initiative reports is to serve as the basis for the Commission when it decides to present legislative proposals to the parliament. If this own initiative report is adopted by the parliament, it will strengthen the Commission’s position if and when it wants to propose various ”self-regulation” schemes in the future.

Although I completely agree that eliminating outdated gender stereotypes in the EU is a worthwhile goal, I will be voting against this resolution next week.

  2. Gender stereotypes can’t be legislated away anyway. Nor can they be censored away. Such censorship wouldn’t do anything for its stated purpose, but would easily be abused for other purposes. Politicians always seem to think that any problem can be solved with yet another law. To me it’s obvious that fighting prejudice requires completely different metods.

  4. There is nothing wrong with gender stereotypes. It is a statistical neutral description of how the world works and it helps us to better understand the driver for interaction between men and women.

    Women are more caring and nurturing by their nature as that prepares them for their role as mothers, while men are more aggressive and competitive. The competitiveness between men is mostly driven by women, as they prefer to mate with the successful alpha males.

    IF anyone wants to reduce this stereotyping they should target their criticism at women and popular women’s media and try to convince them to stop being so cynical and manipulative in their choice of male partners. Begin by banning reality TV dating shows such as Bachelor and magazines such as Cosmopolitan. And maybe a new EU-agency with a multi-million budget with the aim of ”changing attitides” among women and censoring popular womens media and TV entertainment. Not?

  11. It sucks that an important issue like working to eliminate gender stereotypes [and, with that, inequalities] is undermined by including something patronising and incomprehensible like that…

    @Max Pont: Why so misogynistic?

    While it is true that gender stereotypes are being perpetuated not only by media, but by people brought up around gender stereotypes as well, it is very short-sighted to attribute this to women only. Also, please note that contrary to popular belief there is no scientific evidence indicating that gender stereotypes are rooted in biology.

  16. I think this legislation will appeal (for the most part) to a muslim minority in Europe. What exactly are forms of pornography in media & advertising? Could this relate to e.g. Sloggi billboards? I guess for some people these billboards can be interpreted as a form of pornography.

  20. Are we even given a chance to vote against this, don’t the people have a say in what they will or will not see on the internet? I really don’t see the problem with women’s rights, right now. It’s improved and will continue improving, it just takes time. I mean today we have women sitting at the top of large corporations. We have a black president in the US .. and who do you think holds the real power there??? His wife. I think they’ve waited for the best possible time to put this out there though, with everything that’s happening in India right now, but India isn’t Europe and we know they’re backwards when it comes to women’s rights. The EU is fine as it is and it’s progressing well with women’s rights, Kartika Tamara Liotard needs to head to India and try and do something to help them . . I wonder what was so bad that happened in her life that she has to f**k things up for everyone else.

    Reading the web comic Saturday Morning Breakfast Cereal, I noticed that the comic is pervasively non-homophobic and fairly racially diverse. I noticed this because by comparison, mainstream media is pervasively heteronormative and largely racially unrepresentative. Even those with the best will in the world—and regulations like the BBC’s—are influenced by our society’s assumptions.

    The proposal’s goal is right.

    Anti-misogyny porn:

    This proposal seems to assume that all pornography is abusive, which is demonstrably false. Most “mainstream” pornography *is* misogynistic and objectifying (and therefore rubbish). However, some pornography is not. Some pornography actively attempts to subvert gender stereotypes. (Queer Porn Tube has many examples.)

    Pornography can be an educational resource, if it isn’t misogynistic or otherwise problematic. We applaud depictions of healthy, respectful romantic relationships as role models for children. Our society needs more depictions of healthy, respectful sexual relationships.

    Overzealous censorship:

    The majority of content is “good”, so a censor’s job is framed as identifying and blocking the “bad” content. Failing to block “bad” content therefore seems like more of a failure than incorrectly blocking “good” content. So censors will always have a tendency to be overzealous.

    Third-party censorship necessarily imposes the censor’s world-view on the end user. For example, on my mobile phone (on EE’s network), i can’t read a web comic called “I Was Kidnapped By Lesbian Pirates From Outer Space”, presumably because EE’s censoring software was written by a straight man whose only experience of “lesbians” was in sexually explicit content (the comic contains none). I worry that this censorship prevents young queer people from finding support online.

    We can fix it:

    If we want to avoid censorship by internet service providers, we need to bypass them altogether. We need a freely-available, publicly-accountable (ie open source) mesh network (see enwp.org/wireless_mesh_network ).

  34. I don’t know how the EP plans to do that. ”Pornography” is a very open term and it is very open to interpretation. And with the diverse moral values in the European Union, it will be next to impossible to find any common ground to execute and enforce such a motion. For example, who will be the ones who determine what is pornographic and what is not? This is not an issue that is clear cut–it has many grey areas. I doubt that such a measure will pass anyways because they are simply too much ambiguity.

  45. @31: Sorry, but from what I know, most of these studies were not conducted in a very serious way. There is one – it seems – very popular about infants’ reactions to human contact. But in this one, for example, it was neither made sure that the conditions were the same for all babies, nor that the test person [for the interaction] did not know the sucklings’ sexes. It also couldn’t be reproduced to my knowledge.

    Other types of studies are with apes. And, sorry, apes aren’t exactly human. If a female ape chooses a baking pan as a toy, it says nothing about her will to cook with it or be a good housewife or be nurturing or what have you. I don’t know what it means, but certainly not that apes know how to cook.

    Of course, there’s also the problem that studies which find nothing during their investigations, are oftentimes not published or, if they are, don’t get a lot of attention. After all, who is interested in a study declareing ”no connection between biological sex and colour preference found”? Sounds rather boring to most, I guess.

    While I do see where evopsych is coming from, it doesn’t appear to be such a great way to tackle those issues imho. After all, evolutionary mechanisms are largely not in play anymore – at least not in the First World [see rise of physical illnesses/shortcomings/etc. among humans]. A lot of stereotypes can’t be explained evolutionary psychology anyway, because they wouldn’t make sense in that context. On the other hand, a physically strong woman would, because she would be better fit to protect her children, thus increasing their chances for survival and abundance in the gene pool.

    My problem with stereotypes is that more often than not, they are employed to sort humans into categories without consideration of their actual character. It also supports fostering negative views based on past experience [which is usually not a good thing]. Plus, there’s a chance people get pushed into a certain direction because stereotypical behaviour is not only expected of them, but also rewarded. This actually happens a lot with grown-ups who – perhaps [un|sub]consciously – hustle [their] children to adopt common gender roles/stereotypes.

If legislation in these areas was in a better state there would be less of an opportunity to use it as a Trojan horse for introducing widespread state and commercial censorship. I fear that the rests of our European democracies that were once healthy are increasingly running the risk of being thrown out wholesale.   77. I’m a young single female and the only way I can explore sexuality safely is because of porn.

    I am not married and have no way of getting ‘laid’ without fear of STDS, Condoms, Babies, or the ”wrong guy”. Due to complications from religion I am unable to watch any sex-decipted scenes or shows on modern television. However thanks to the internet I am freely able to view and explore both erotic and porn as well as fantasy erotica and fantasy porn freely and privately without these inconviences listed above. Porn has also help quench and satisfy my masturbation problems, as I have orgamisms up to 4 times or more a day.

    I realize as a lady that I have a sexuality now. Many times porn has answered questions I had that would be either impossible to talk about, severely avoided or embarassing to even mention to others. Porn on the internet gave me the keys to my freedom in sexuality and lifted the bondages of religious persecution about sex and the ignorance of the unknown or how the body works.

    Now you are attempting to take that liberty away. From both males and females who would like to explore sex safely and for those who need an outlet to relieve themselves in. Your bans are no more gender-discriminating than the mysgonist you so claim to be erodicating and correcting. Male or Female should be entilted to express their sexualities without the government sticking it’s eyes in people’s personal or private lives unless it is life-threatening or causing immediate harm to those involved.

    This is not a ‘strike-back’ on mysgonist behavior or thinking which remains rampant in even the most ‘covered-up’ countries like Middle-East. This is a clear and emtept attempt to ban and censor all expression of human sexuality be it from a male’s point of view or a female’s point of view under the most stiff-necked assumptions and demonization about sex period.

    For whom does sexuality belong to. The people rights to express or to the governments control to censor?
