IFPI’s child porn strategy

”Child pornography is great,” the speaker at the podium declared enthusiastically. ”It is great because politicians understand child pornography. By playing that card, we can get them to act, and start blocking sites. And once they have done that, we can get them to start blocking file sharing sites”.

The venue was a seminar organized by the American Chamber of Commerce in Stockholm on May 27, 2007, under the title ”Sweden — A Safe Haven for Pirates?”. The speaker was Johan Schlüter from the Danish Anti-Piracy Group, a lobby organization for the music and film industry associations, like IFPI and others.

I was there together with two other pirates, Pirate Party leader Rick Falkvinge, and veteran Internet activist Oscar Swartz. Oscar wrote a column about the seminar in Computer Sweden just after it had happened. Rick blogged about it later, and so did I. (All links in Swedish.)

”One day we will have a giant filter that we develop in close cooperation with IFPI and MPA. We continuously monitor the child porn on the net, to show the politicians that filtering works. Child porn is an issue they understand,” Johan Schlüter said with a grin, his whole being radiating pride and enthusiasm from the podium.

And seen from the perspective of IFPI and the rest of the copyright lobby, he of course had every reason to feel both proud and enthusiastic, after the success he had had with this strategy in Denmark.

Today, the file sharing site The Pirate Bay is blocked by all major Internet service providers in Denmark. The strategy explained by Mr. Schlüter worked like clockwork.

Start with child porn, which everybody agrees is revolting, and find some politicians who want to appear like they are doing something. Never mind that the blocking as such is ridiculously easy to circumvent in less than 10 seconds. The purpose at this stage is only to get the politicians and the general public to accept the principle that censorship in the form of ”filters” is okay. Once that principle has been established, it is easy to extend it to other areas, such as illegal file sharing. And once censorship of the Internet has been accepted in principle, they can start looking at ways to make it more technically difficult to circumvent.

In Sweden, the copyright lobby tried exactly the same tactic a couple of months after the seminar where Johan Schlüter had been speaking. In July 2007, the Swedish police was planning to add The Pirate Bay to the Swedish list of alleged child pornography sites, that are blocked by most major Swedish ISPs.

The police made no attempt whatsoever at contacting anybody from The Pirate Bay, which they of course should have done if they had actually found any links to illegal pictures of sexual child abuse. The plan was to just censor the site, and at the same time create a guilt-by-association link between file sharing and child porn.

In the Swedish case, the plan backfired when the updated censorship list leaked before it was put into effect. After an uproar in the bloggosphere, the Swedish police was eventually forced to back down from the claim that they had found illegal child abuse pictures, or had any other legal basis for censoring the file sharing site. Unlike in Denmark, The Pirate Bay is not censored in Sweden today.

But the copyright lobby never gives up. If they are unable to get what they want on the national level, they will try through the EU, and vice versa.

The big film and record companies want censorship of the net, and they are perfectly willing to cynically use child porn as an excuse to get it. All they needed was a politician who was prepared to do their bidding, without spending too much effort on checking facts, or reflecting on the wisdom of introducing censorship on the net.

Unfortunately they found one in the newly appointed Swedish EU commissioner Cecilia Malmström. In March 2010 she presented an EU directive to introduce filtering of the net, exactly along to the lines that Johan Schlüter was advocating in his speech at the seminar in 2007.

I assume that commissioner Malmströms’s motives are honourable, and that she genuinely believes she is doing something good that will prevent sexual child abuse. But sweeping a problem under the carpet, or hiding it behind filters, can never be the proper solution. If there actually are sites distributing pictures of sexual child abuse openly on the net, the sites should be shut down and the people behind them should be put in prison (after a proper trial).

But Cecilia Malmström
‘s Internet censorship directive will have no effect at all on sexual child abuse in the world. All she will have achieved if she is successful with this directive, will be to legitimize the principle of Internet censorship in Europe, just like the copyright lobby wanted her to.

It would be very sad if she succeeds.

    Texten “Om det verkligen finns sidor som distribuerar…” ger visst sken att du skulle vara skeptisk till att dessa sidor faktiskt finns. Tror inte att det är det du vill förmedla.

    I agree with stroll. You should do what you can to get it published in some big newspaper, Swedish or European.

    Notera att han syftar på sidor som distribuerar detta material helt öppet, vars påstådda omfattning många är kritiska till. Om det nu skulle finnas hemsidor som helt öppet sprider barnporr så ska de helt enkelt tas bort och ägarna åtalas enligt Engström. De flesta verkar vara tämligen överens om att majoriteten av detta material sprids i slutna kretsar, vilket gör internetcensur till ett oerhört trubbigt vapen.

    In the first alternative we should have someone else responsible. In the second they are almost criminal.

  22. Next time, bring a camera or audio recorder. This is not surprising anyone who has followed the issue; it’s obvious that they’re trying to get filters in place any way they can.
    What we need though is a video of them saying what they said according to this blog, an undeniable recording instead of a transcript on a biased – though biased in the right direction 😉 – website like this. If we had an IFPI lawyer literally saying ”child pornography is great [for the content industry]” on camera and someone leaked it, things would get moving. That’s something you can campaign with, something ”old news” will pick up on and ask politicians about. I’d hope so, anyway.

  34. Mycket bra inlägg! Håller med ovanstående om att du borde skicka in det här till tidningarna! PP är fantastiskt bra på att synas på internet OM man läser bloggar. Det är därför ni har så många röster bland förstagångsväljare. Däremot måste PP jobba med att synas i gammelmedierna, som fortfarande är sättet de flesta konsumerar information. Mina föräldrar röstade på PP och var besvikna för de hade inte hört talas om er sen Europaparlamentsvalet, vilket förvånade mig otroligt, jag hör ju varje dag hur mycket ni uträttar därnere. Ni behöver alltså synas på andra plattformar också.

    Because we live in a society where child pornography is not a subject independent academics and journalists can research, anti-child pornography is authoritarianism. It drives us politically precisely where we have little right to judgment. COPINE is just a wing of the police establishment. Every well funded project is.

    Lazy civil libertarians will decry the attack on wholesome file trading, the sort grandma used to do, but fail utterly to examine the root causes of this endless, and irresistible push for absolute censorship. And, yes years too late, they will see that some anonymous posting was right.

Wir werden kontinuierlich die Kinderpornographie im Netz überwachen um den Politikern die Wirksamkeit unsers Filters zu zeigen. Kinderpornographie ist etwas, was sie verstehen“ sagte Johan Schlüter mit einem Grinsen; sein ganzes Wesen strahlte einen Enthusiasmus und Stolz vom Podium aus.

    Aus Sicht der IFPI und anderer Copyright-Lobbies, hatte er nach dem Erfolg mit seiner Strategie in Dänemark wirklich allen Grund, Stolz und Enthusiastisch zu sein.

    Heute ist die Site ThePirateBay.org von allen großen Internet Service Providern in Dänemark geblockt. Die Strategie von Herrn Schlüter funktionierte wie ein Uhrwerk.

    Beginne mit Kinderpornographie, bei der jedermann zustimmt, dass es abscheulich ist. Finde dann einen Politiker, der den Anschein erwecken will etwas dagegen zu tun. Erwähne niemals, dass das Blockieren lächerlich einfach in weniger als 10Sekunden zu umgehen ist. Das Ziel in dieser Phase ist lediglich die Politiker und die allgemeine Öffentlichkeit davon zu überzeugen, dass eine Zensur in Form von Filtertechniken „okay“ ist. Wenn dieses Prinziep erst einmal etabliert ist, ist es einfach es auf andere Bereiche, wie das File Sharing auszuweiten. Und wenn die Zensur erst einmal im Prinzip akzeptiert wurde, kann man anfangen Wege zu suchen, die Umgehungsmöglichkeit technisch schwieriger zu gestalten.

    Einige Monate nachdem Johan Schlüter dieses Seminar gehalten hatte, versuchte die Copyright-Lobby dieselbe Strategie in Schweden. Im Juli 2007 plante die Schwedische Polizei die Website ThePirateBay.org auf die Liste der geblockten Kinderpornographieseiten zu setzten.

    Die Polizei unternahm keinen Versuch jemanden bei ThePirateBay.org zu kontaktieren, was sie tun sollten, wenn sie irgendeinen Link zu Kinderpornographie gefunden hätten. Der Plan war es lediglich die Seite zu zensieren und eine „Schuldig-Verknüpfung“ zwischen Kinderpornographie und File Sharing herzustellen

    Im Schwedischen Fall ging der Schuß nach hinten los, als die Zensurliste an die Öffentlichkeit gelangte, bevor sie Wirkung zeigen konnte. Nach einem Aufschrei in der Blogosphäre war die Polizei möglicherweise gezwungen, sich von Ihrer Haltung zu distanzieren, die Seite aufgrund (angeblich) gefundenen Kinderpornographischem Materials oder anderer legaler Gründe, auf die Zensurliste zu setzten. ThePirateBay.org ist in Schweden bis heute nicht zensiert.

    Aber die Copyright-Lobby gibt niemals auf. Wenn sie auf nationaler Ebene nicht bekommt, was sie will, dann versucht sie es auf der EU-Ebene und vice versa.

    Die großen Film- und Plattenfirmen wollen Zensur im Netz und sie sind absolut zynisch gewillt auch Kinderpornographie als Entschuldigung dafür zu verwenden. Alles was sie dazu brauchten, war ein Politiker der dazu vorbereitet war, ihr Verlangen zu erfüllen, ohne die Fakten zu genau zu Prüfen, oder das Wissen des Netzes über die Einführung von Zensur zu reflektieren.

    Unglücklicherweise fanden sie einen Politiker in der neu berufenen EU-Kommissarin Cecilia Malmström. Im März 2010 präsentierte diese eine Direktive zur Einführung von Filtern für das Internet, welche sich exakt an die durch den Vortrag Johan Schlüters vorgegebene Linie hält.

    Ich nehme an, dass die Motive der Frau Kommissarin ehrenwert sind und sie selbst wirklich glaubt etwas Gutes zur Prävention gegen Kinderpornographie zu tun. Aber ein Problem unter den Teppich zu kehren, oder es hinter Filtern zu verstecken, kann niemals die richtige Lösung sein. Wenn aktuell Websites Bilder von Kindesmissbrauch verbreiten und offen zugänglich sind, dann sollten diese abgeschaltet und die Hintermänner ins Gefängnis gesteckt werden (nach einer ordentlichen Verhandlung).

    Aber Cecilia Malmströms Internet-Zensur-Direktive wird keinerlei Effekt auf Kindesmissbrauch in der Welt haben. Alles was sie erreichen wird, wenn diese Direktive Erfolg hat, wird sein, dass das Prinzip der Zensur in der EU legalisiert wird – genau so wie es die Copyright-Lobby von ihr gewünscht hat.

    Es wäre sehr traurig, wenn sie Erfolg hätte.

Government issued ”Home Access” laptops have a built in filter on the parent account, and as well as filesharing, lots of feminist and gay rights sites are now censored as Adult/Porn. Petertatchell.net, pandagon.net, jezebel.com, gays.com, ukgaynews.co.uk and so on. Non-microsoft software like pidgin.im is blocked as adult (MSN messenger is allowed). The eff.org is blocked as the ominous ”Other Threats”.

  79. I’m not European but that’s very disturbing. Such filter would turn Europe into another China and soon other places would follow. Obviously fighting against child pornography is a must because it’s one of the worst things the human being is capable of but such filter would be both useless for countering any CP and it would be used for other purposes – we are seeing China taking action against whoever they want using the pornography as an excuse.

    It is obvious it would fail. As it was pointed we don’t stumble on CP sites on our daily browsing simply because they usually aren’t open for the public (if such sites exist) or they use other means to distribute among a select few members – I’d assume bittorrent is one of the channels but obviously other common means such as ftp, e-mail and even https must be used – so IFPI and similar organizations are planning to block the internet? Seriously, filtering will not solve the problem and will create a burden for law abiding citizens. I was reading the other day how Google blocked a site with artistic pictures of children because some fundamentalist pointed it as child porn. It’s not child porn. Now imagine what would be the consequences of such filter?

    Also, IFPI/MPAA/FACT/whoever are keen to fight piracy but if you are a good paying customer they couldn’t care less. I mean, when you buy DVDs and Blu-rays you are forced to watch trailers and stupid FBI/copyright warnings or even do firmware updates to play your movies (that if they actually can be played at all). From my end, I do want to buy the original for the good works but even if I buy it’s better to stick with the ‘pirated’ version since it doesn’t have any DRM idiocies – STOP MAKING YOUR CUSTOMERS GO THROUGH UNNECESSARY HASSLES.     There might be some of my personal rant up there but the fact is that this should be stopped and IFPI should apologize for those disgusting comments.     As you see if you carefully read this blog post the matter was discussed in the blogosphere at the time it happened. But I suppose that those discussions were primarily carried out in swedish. For those of us who have been following the discussion this of course old news, but it still provides a valuable perspective on the latest developments in the EU politics. Considering the response and number of ping backs it seems it’s worth reiterating this story in English.

  105. Mycket bra avslöjande. Bra jobbat Chrisitan! Kanske har ni min röst i nästa val också. Lobbyn och deras metoder ska fram i dagsljuset.

    Bara en liten sak att anmärka på. Du själv utnyttjar (kanske utan att veta) en del myter om barnpornografi i din argumentation. Att säga ”child porn, which everybody agrees is revolting,” är en rejäl överdrift. Dels finns det självklart pedofiler som inte alls tycker att barnporr är motbjudande. Dels så är barnpornografiklassningen väldigt godtycklig och slarvig, och en del saker som knappast ses som motbjudande är klassade som barnporr.

    Antipiratmaffian utnyttjar en stereotyp bild av barnporr, i ett retoriskt syfte. Bilden går ut på att all ”barnporr” är dokumenterade övergrepp där vuxna utnyttjar barn. Så är (lyckligtvis) inte fallet. Tecknade bilder och filmer är ett av flera exempel där ingen levande människa kommer till skada. Ett annat exempel som komplicerar bilden är att många tjejer i tonåren uppenbarligen tar bilder på sig själva, bilder som ibland sprids på internet. Där är det inte heller någon vuxen gärningsman med. Genom att överdriva problemet med barnporr gör sig maffian ett argument för ett nedlåst internet. Våga granska barnporren, och avväpna antipiratmaffian. Läs vad Oscar Shwartz har skrivit i ämnet!

    Låt gå för att piratpartiet, som redan har fått en massa skäll för en miljard irrelevanta skitsaker (typ OH NOES ni går med i samma partigrupp som MP eller FP redan är med i, KNARKVARNING) kanske inte vill förknippas med pedofili…

    I wrote about it (in Swedish) in February 2008 as well, when the Swedish police was proposing to block The Pirate Bay using the same (bogus) argument.

  128. Excellent brief article on an issue which will have an increasingly large bearing on the future of tech society in Europe. The American and Chinese experiences have both consistently demonstrated two things:
    1- That the network perceives censorship as damage and routes around it.
    2- That censorship and tech regulation based on 18th century intellectual rights concepts, if actually achieved, merely serve to stifle innovation and hamstring the tech economies which achieve such censorship while granting a competitive boost to others (an effect of the above item)

    Hopefully some day societies will come to identify that there is a difference between a book and a number which can represent the information contained in the book, as well as creating a proper classification for software which is not adequately covered by existing literary copyright or patent laws.

  145. It is even worse than putting filters and closing sites. What these guys are trying to do is to scare people. All these bureaucrats and government agents know that the only way to rule is using terror. They are the real terrorists. I have seen in a site the news that a man mistakenly downloaded child porn and a year later FBI was searching his computer and arrested him. The news said that he was facing a heavy jail sentence. Now, I don’t know if the story is true, but the message under it is: if you download anything you can go to jail for being paedophile even if you aren’t!

    The only way to fight these people is getting public support and public pressure on the MP’s.

    Now, seriously, doesn’t it look to you that this Schluler has an aura and looks like a paedophile? or is it just my impression?

    Last, but not least, remember the case of paedophilia in Belgium some 10 years ago, a very extensive case involving many children, kidnapping, imprisonment and a judge who was investigating it thoroughly was fired by the government? He was getting close to the culprits, very powerful people with influence/participation in the government. So, real paedophiles are not the people who mistakenly download a piece of crap in their computer. I believe governments don’t really want to stop paedophilia.

  152. Absolutely correct, this is very ridiculous. Because of the serial unwillingness to actually define anything in a useful way ”child”, in this part apparently means any drawing interpreted to be ”below eighteen”, like your random character in some random high school shôjo manga, or any person who the government decides *looks* under eighteen or any other character that just looks to be at most seventeen, in some sort of ”sexual” situation, which is again is not specifically defined but is left comfortably open letting them censor anything they decide. And I do mean anything since the only criteria for censorship is that they decide something *appears* to be sexual (which can mean anything) involving someone who *appears* to be underage” Anyone here reading, watching, consuming media of some kind that has a child character? Gosh, you must be a pedophile.

    I can only dryly stop to remember that this moral outrage is brought to us by the country that keep it’s age of consent at the disturbingly low age of 15.

    Next note the part right above the anti-manga/anime screed that states that any image of a real person that ”appears” to be below eighteen is to be illegal. That same sentence means that it is illegal for anyone above the age of 18 and far above that to wear “childish clothing”, Lolita fashion, or anything similar to the aforementioned in an image depicting a situation that is ”interpreted” to be “sexual”.

    Are you fucking kidding me?

    We all know what the real idea here is, because if you can ban one art form — harmless in its creation — without proof of any kind, just based on the assumption it’s harmful, well then fuck, can’t we ban Communistic literature too? All we need is someone with a shiny badge or pressed suit to tell us it’s evil and undermining the peace and then art is removed from the market? That isn’t free speech and it isn’t Democracy. In a Democracy, to paraphrase Isaac Asimov, all people must be given a say regardless of content and we the people hear them and can embrace or reject what they say. But when this morphs into the government “protecting” us from certain ideas it decides it doesn’t like then that’s not free speech any more now is it? You can either speak freely or you can’t, and apparently we can’t. And while you might find it benign to ban some shady manga you’ve never read, the legal implications of what they’re doing are stunning.

This will help get the word out on these types of methods to make the slippery slope not just steeper, but also more slippery by use of deception on the public and appealing to politicians who are desperate for something to try to look like they’re doing something.
